The U.S. Food and Drug Administration (FDA) banned Juul vapes following a two-year investigation of the vaping giant’s request for permission to keep selling fruit-flavored goods. In response to appeals from anti-tobacco organizations to take action against goods that contributed to an increase in youth vaping over the past ten years, the FDA examined Juul’s marketing applications as well as those of hundreds of other businesses.

The FDA mandated that all e-cigarette and vaping businesses submit applications in order to keep promoting their goods starting in 2020. Additionally, the FDA outlawed the sale of fruit and mint-flavored e-cigarettes and vaping cartridges.

However, menthol and tobacco-flavored items were exempt from this rule. Outrage erupted when the FDA refused to rule on Juul in September 2021 and instead prohibited the sale of hundreds of thousands of vaping and electronic cigarette products.

Juul’s sales and distribution of its products in the US were banned by the FDA on June 23, 2022. They were ordered to be removed from the U.S. market immediately to avoid enforcement action.

The FDA issued Juul Labs Inc. marketing denial orders (MDOs), which only apply to the commercial distribution, importation, and retail sales of these products and do not prevent personal possession or use.

At last, the FDA prohibited Juul from selling specific products because the company’s premarket tobacco product applications (PMTAs) did not provide enough proof of the products’ toxicology to show that their marketing would be appropriate for the protection of public health. Even though it had more than 5,000 lawsuits, Juul paid $255 million to resolve a class action lawsuit alleging that the business engaged in dishonest marketing tactics. Juul also agreed to pay more than $432 million in September 2022 following probes in numerous states over how it may have advertised to teenagers. And in December 2022, the company agreed to pay between $1.2 and $1.7 billion with 10,000 plaintiffs in 5,000 instances in California.
